A GUNNEDAH man has been bailed after a court was told he'd been booted from a residential rehabilitation program for testing positive to the drug ice.

Solicitor Yvonne Phillipos said her client, Peter Joseph Lennan, had completed the Balund-a program near Tenterfield and, despite the breach, "has come to court" and "hasn't required a warrant".
The court heard Lennan was in a Balund-a cabin "where they put them in the drug detox" and another inmate "has smoked ice".
"Mr Lennan has inhaled it ... They have then breached him in that regard," Ms Phillipos said.

As part of his bail, Lennan must not contact co-accused, is prohibited from taking drugs and must regularly report to police.
He's also subject to an overnight curfew, and must attend drug and alcohol counselling.
Strike Force Munderrah, a covert operation by Oxley detectives, alleges he was the head of the criminal group supplying drugs across the town.
He was granted bail in Tamworth court earlier this year on a specialist Balund-a bail remand order to attend the rehab program, after admitting to possessing testosterone and using an unregistered vehicle.
He is also charged with other offences including participating in a criminal group and supplying drugs on an ongoing basis, but is yet to enter pleas.
Ms Phillipos said her client had completed the intensive rehabilitation program, which is run by Corrective Services, but had been breached for testing positive to drugs.
"Unfortunately, they informed me that he had been breached," she said.
She said the case needed to be listed for a variation to bail because Lennan had been dropped from the program.
But she was "unaware of his whereabouts" and she did not have a mobile number for him because "he's been in correctives' custody".
Lennan arrived at court later in the day, with his co-accused girlfriend, Rikki Stranlund.

Ms Phillipos asked for him to be bailed to live with a family member in Gunnedah while the case progresses.
Ms Soars said she was concerned about the bail conditions because it "puts him back into the same community where the alleged offending occurs".
However, the DPP didn't oppose the bail variation.
As part of his bail conditions, Lennan is prohibited from contacting any co-accused except Stranlund.
He's prohibited from taking drugs and must report to police on Mondays, Wednesdays and Fridays.
His curfew is from 9pm to 7am, and he must attend drug and alcohol counselling.
Lennan will return to court later this month.
